New York Dealer Client Challenges Stellantis Vehicle Ordering System
BSM has filed an administrative protest on behalf a of New York Chrysler Dodge Jeep Ram dealer challenging Stellantis’ new “customer-match” rules associated with vehicle ordering and allocation. The Stellantis program sets a threshold on the percentage of customer sold orders which must be sold to the original ordering customer in order to continue to be able to place customer sold orders.
Stellantis’ change to its allocation system related to customer sold orders is an adverse modification to our dealer client’s franchise and subject to protest under New York motor vehicle franchise laws. The customer match rules do not take into account that the dealership has no control over whether a customer ordering a vehicle ultimately purchases that vehicle. With significant delays in delivery time, many customers choose to acquire a different vehicle or change their mind altogether due to factors such as increasing finance rates.
