Dealers Oppose Lucid’s Attempt to Obtain a License in Pennsylvania
BSM submitted an Amicus Curiae brief on behalf of the Pennsylvania Automotive Association (PAA) in opposition to Lucid’s appeal of a denial for a motor vehicle dealer’s license by the State Board of Vehicle Manufacturers, Dealers and Salespersons. Lucid argued that the Boards decision and Pennsylvania franchise laws denied it substantive due process, procedural due process, equal protection under law, among other grounds. NADA also submitted a brief in opposition to Lucid’s appeal. The appeal is fully briefed and awaiting a decision from the court, which may come over the Summer. It is reasonable to expect that Lucid will continue to seek licenses in states where it believes it will have favorable Boards and/or franchise laws, so this is an issue to continue to monitor.
