BSM and Hagens Berman File Appeal on behalf of VW Dealer Class

BSM and its co-counsel, Hagens Berman, recently filed an appellate brief seeking to overturn the trial court’s dismissal of the VW dealers’ claims against Robert Bosch GmbH and Robert Bosch, LLC.  The appeal was made to the 9^th Circuit Court of Appeals.

We believe the trial court erred in dismissing the VW dealers’ claims and have made detailed arguments to the appellate court supporting our position.  The Bosch entities will have an opportunity to file a brief in support of the trial court’s order in mid-July.  Thereafter, the 9^th Circuit Court will determine whether they will rule on the briefs as filed or whether they will allow oral argument on the issues.  Any decision by the 9^th Circuit on the merits of the appeal is not expected for some time.
