BSM Hired To Litigate Against Scout in Washington
After being asked to represent dealers and dealer associations in Colorado and Florida to prevent Scout from violating the law in those states, the Washington State Automobile Dealers Association (WSADA) has retained BSM to do the same.
Washington law provides that a manufacturer or any affiliated entity may not act in the capacity of a motor vehicle dealer in the State. WSADA seeks to enforce the law by asking the Court to enter a declaratory judgment that Scout’s activities in the State violate this prohibition. These activities include advertising Scout vehicles for sale, displaying Scout vehicles, taking deposits and entering into reservation agreements for the purchase of a Scout vehicle with Washington state residents.Â
WSADA seeks not only a declaratory judgment against Scout but an injunction permanently prohibiting Scout from engaging in the activities of a new motor vehicle dealer along with WSADA’s attorney fees and costs incurred in bringing this action.
BSM attorneys, Shawn Mercer and Jason Allen, are the lead attorneys in the case.
